2.1 / Types of information collected
(a) Traffic data colleted.
We may track and collect the following categories of information when you visit our Site: (1) IP addresses; (2) domain servers; (3) types of computers accessing the Site; and (4) types of web browsers used to access the Site (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving your experience on the Site. We also use “cookies” to customize content specific to your interests, to ensure that you do not see the same advertisement repeatedly, and to store your password so you do not have to re-enter it each time you visit the Site (see Section 5 below).
(b) Personal information collected.
We provide you with the opportunity to (i) request information about boat ownership or membership in our SailTime program, and (ii) schedule charters and classes through the Site. In order for us to provide you with these services, our online forms request certain information that will personally identify you (“Personal Information”). Personal Information includes, but is not limited to your name, e-mail address, physical address, information you may provide in our comment sections, information you communicate with us via email, and logistic information for the booking of charters and classes, such as dates, type of charter or class. When you process a payment, financial data will be collected indirectly through our third-party processor (“Financial Data”).
2.2 / Uses of information collected.
(a) Company use of information
.We may use Personal Information to send you information about the Company or our products via brochure or email, track sales and communications, provide customer service, perform research, respond to inquiries, schedule classes, schedule charters, and facilitate your purchases of boats or SailTime membership. Naos Yachts does not retain and does not have access to your Financial Data. We will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of our legitimate business interests and satisfying any legal or reporting requirements.
(b) Sharing of peronal information.
Except as set out in this Privacy Policy, the Company does not disclose or sell your Personal Information to any third-parties. We may, however, disclose your Personal Information to third-party service providers who perform services on our behalf. For example, we may hire other companies to provide data storage, to host websites, to assist in marketing, to conduct audits, process payments, etc. When we engage another company to provide such services, we may provide them with information, including Personal Information and Traffic Data in connection with their performance of such services. These third-party service providers (i) shall be permitted to obtain only the Personal Information they need to provide the service, (ii) must protect Personal Information to the same extent as the Company, and (iii) shall be prohibited from using it for any other purpose. These third-parties are listed below, and may be updated by Naos Yachts, Inc. from time to time:

- Google Drive
- Sailtime
- YachtWorld
- CYBA
- Heartland
We may also provide your Personal Information to any companies we have a dealership agreement with, such as but not limited to Beneteau America, Inc. (each a “Manufacturer” and collectively the “Manufacturers”). Manufactures may use your Personal Information for purposes of promotion and services of the Manufacturer. No EEA member data will be shared with Manufacturers without consent.
3/ ACCESSING YOUR PERSONAL INFORMATION
In accordance with applicable privacy law, you have the following rights in respect of your Personal Information that we hold:
- Right of access and portability. The right to obtain access to your Personal Information along with certain information, and to receive that Personal Information in a commonly used format and to have it ported to another data controller.
- Right to rectification. The right to obtain rectification of your personal information without undue delay where that personal information is inaccurate or incomplete.
- Right to erasure. The right to obtain the erasure of your Personal Information without undue delay in certain circumstances, such as where the Personal Information is no longer necessary in relation to the purposes for which it was collected or processed.
- Right to restriction. The right to obtain the restriction of the processing undertaken by us on your Personal Information in certain circumstances, such as where the accuracy of the Personal Information is contested by you, for a period enabling us to verify the accuracy of that Personal Information.
- Right to object. The right to object, on grounds relating to your particular situation, to the processing of your Personal Information, and to object to processing of your Personal Information for direct marketing purposes, to the extent it is related to such direct marketing.

You may access, correct or request deletion of your personal information by logging into your account, or by contacting us. We will respond to your request within 30 days.

5/ USE OF COOKIES AND OTHER TECHNOLOGIES
Cookies offer you many conveniences. They allow us to identify registered users when they return to the site so that they can retrieve previous image search results and view their previous account balances. Cookies also save you time by eliminating the need to repeatedly enter the same information.
In some cases, our third-party service providers may use cookies on our sites. We have no access to or control over these cookies. This Privacy Policy covers the use of cookies by the Company only, and does not cover the use of cookies by third parties.
You have the ability to accept or decline cookies. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies. If you choose to decline cookies, you may not be able to sign in or use other interactive features of our sites and services that depend on cookies but you will be able to perform basic navigation through the site.
In addition to cookies, we may use other technologies, including single-pixel gifs (also known as web beacons) on our websites and in promotional e-mail messages or newsletters. These tiny electronic images assist us in determining how many users have visited certain pages or opened messages or newsletters. We do not use these images to collect Personal Information.

- limiting access to your Personal Information to those of our employees who require it to provide services to you;
- requiring employees to sign confidentiality agreements to protect customer and other confidential information;
- ensuring that third-party service providers sign confidentiality agreements to maintain the confidentiality of your Personal Information and not to use it for any unauthorized purposes;
- storing your Personal Information in secure computer systems which protect it from unauthorized access or use.
The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure.
However, please be aware that no method of transmission over the Internet, or method of electronic storage is 100% secure and we cannot guarantee the absolute security of the Personal Information we have collected from you.
Except as otherwise provided in this Privacy Policy, we will keep your Personal Information private and will not share it with third parties, unless such disclosure is necessary to: (a) comply with a court order or other legal process or other requests (including criminal and civil matters) if we have a good faith belief that the response is required by law; (b) protect our rights or property; (c) when we have a good faith believe it is necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, or to protect ourselves and you from people violating our terms of us or this Privacy Policy; or (d) enforce our Terms of Use. Disclosures under (a)-(d) may include sharing information with other companies, lawyers, courts or other government entities.
7/ Children's privacy
We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you learn that your Children have provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from children under age 13 without verification of parental consent, we take steps to remove that information from our servers.
